VILLAGE BOARD OF TRUSTEES

MEETING MINUTES

November 7, 2011

 

Mayor Don Robinson called the Meeting of the Mt. Zion Village Board of Trustees to order at 5:15 p.m.  The following Board Members were present for roll call:  Matthew Trusner, Dean Otta, Cathy Derby, Rick Bright, Donna Scales, and Kevin Fritzsche. Also present were Jerry Potts, Village Administrator, Chief Doug Dunn, Grant Corum, Director of Public Works, Julie Miller, Village Treasurer, Judy Roessler, Director of Parks & Recreation, and Tammy Mense, Village Clerk. 

 

Pledge of Allegiance

 

Consent Agenda:  A motion was made by Trustee Bright to approve the Consent Agenda as presented, seconded by Trustee Fritzsche.   A breakdown of Fund Warrants for the period ending November 7, 2011 is as follows: General Fund - $67,379.49, Special Funds - $71,943.50, Motor Fuel Tax Fund - $2,230.65, Water Revenue Fund - $37,360.20, Sewer Revenue Fund - $100,158.29, and Risk Management - $617.21. A roll call vote was taken:  Otta-yea, Trusner-yea, Bright-yea, Derby-yea, Fritzsche-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Request for Approval of Resolution Authorizing the Destruction of Audio Recordings of Closed Session Meetings:  Clerk Mense presented Resolution 2011-2012-2 Authorizing the Destruction of Audio Recordings of Closed Session Meetings for August 17, 2009, October 19, 2009, January 4, 2010, January 18, 2011, February 16, 2010, and March 1, 2010 within the required 18-month compliance.  Trustee Derby reviewed the tapes at her request. 

A motion was made by Trustee Bright to approve the Resolution Authorizing the Destruction of Audio Recordings of Closed Session, seconded by Trustee Trusner.  A roll call vote was taken:   Bright-yea, Trusner-yea, Fritzsche-yea, Derby-yea, Scales-yea, and Otta-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Request for Approval of an Ordinance Amending Chapter 110 Alcoholic Liquor Control, Section 110.07 – Classifications of Licenses – Class H – Caterer:   Mayor Robinson briefed the Board on the next three agenda items regarding Ordinances relating to Alcoholic Liquor Control.  The Liquor Commission met on November 3, 2011 to amend Chapter 110 Alcoholic Liquor Control to change the definitions of Section 110.01 for Caterer; and the amendment of Section 110.07 adding a Class H License – Caterer.  This ordinance amendment was presented as a result of the Village of Mt. Zion being unable to obtain a license from the State Liquor Control Commission.  The caterer for the Convention Center, Schutte Inc., dba Secret Recipes will be purchasing the alcohol thus requiring the Village to amend the Ordinance adding a Caterer License (H).  The Commission voted unanimously to recommend the amendment to the Code adding a Catering Class H License.

A motion was made by Trustee Bright to approve the Ordinance Amending Chapter 110 – Alcoholic Liquor Control, Section 110.07 – Caterer as presented, seconded by Trustee Scales.   A roll call vote was taken:  Bright-yea, Derby-yea, Fritzsche-yea, Otta-yea, Trusner-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Request for Approval of Amendment to Chapter 110 Alcoholic Liquor Control – Number of Licenses Under Class A – Rescinding Village of Mt. Zion Liquor License:   Clerk Mense presented this Ordinance as a result of the June  2011 Village Board Meeting amending the number of Class A licenses to three for the Village of Mt. Zion Convention Center.  This ordinance will rescind the Village of Mt. Zion Class A license and as a result will change the number of Class A licenses to two.  This is a housekeeping ordinance as the Village does not keep licenses on the books that are not issued to specific businesses.   

A motion was made by Trustee Scales to approve the Ordinance Amending Chapter 110, Alcoholic Liquor Control, Section 110.09 – Number of Licenses – Rescinding Liquor License for the Village of Mt. Zion as presented, seconded by Trustee Derby.   A roll call vote was taken:  Bright-yea, Derby-yea, Fritzsche-yea, Otta-yea, Trusner-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Request for Approval of Class H License for Schutte, Inc. dba Secret Recipes – Caterer for the Village of Mt. Zion Convention Center:  Clerk Mense presented this request for approval following the November 3, 2011 meeting of the Liquor Commission recommending the issuance of a Class H – Caterer License to Schutte, Inc., dba Secret Recipes.  Travis Schutte currently holds a liquor license in Springfield for the Secret Recipes Conference Center under Schutte Inc.  Fingerprinting of Mr. Schutte will be done by the Mt. Zion Police Department, and forwarded to the Illinois State Police for background check information as is done for all Village of Mt. Zion license holders. 

A motion was made by Trustee Bright to approve the Class H Liquor License – Caterer to Schutte, Inc., dba Secret Recipes for the Mt. Zion Convention Center, 1410 Mt. Zion Parkway as presented, seconded by Trustee Fritzsche.   A roll call vote was taken:  Bright-yea, Derby-yea, Fritzsche-yea, Otta-yea, Trusner-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Request for Authorization fo Approve Grant for Squad Car Purchase:  Administrator Potts presented this request upon word from Chief Dunn that grant money is available for the purchase of a new squad car.  The grant would cover 75% of the cost of the car including the gear necessary through the Federal and State Grant Unit.  If the Village were to take advantage of this grant to purchase a squad car for the FY 2012-2013 budget year would not be necessary.  Based on estimates the grant amount could be $19,627; Village share $7,542; total squad car cost with equipment $21,065.96.   At this time Staff requested approval to agree to the grant acceptance, Board approval to follow for purchase.   Trustee Trusner inquired whether this was a rate opportunity; Chief stated that he felt that it was.

A motion was made by Trustee Scales to direct Staff to proceed with the Federal and State Grant Unit acceptance for the eventual purchase of a squad car, seconded by Trustee Otta.   A roll call vote was taken:  Bright-yea, Derby-yea, Fritzsche-yea, Otta-yea, Trusner-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

Request for Treasurer Authorization to Purchase a Stage from SICO America, Inc for the Mt. Zion Convention Center:  Treasurer Miller obtained three quotes for portable stages for the Convention Center.  At the time of budget preparation it was not known the importance to potential booking that will require a stage for events, as more bookings  come in the necessity of a stage purchase is a necessary expenditure at this time.  The Treasurer requested the purchase of a stage at this time.  The stage needs to be easy to put together and on wheels for mobility.  Renting a stage for events is not practical and expensive.  Treasurer Miller recommended the purchase of a stage from SICO America, Inc., for $15,462.00.  It is felt that if the stage is maintained properly the life expectancy should be at least 20-years.  Additional equipment may be purchased for the stage as necessary.  Trustee Derby stated she was reluctant to purchase a stage with carpeting and requested it to be versatile.  Trustee Bright asked that Miller look into stages that were reversible.  Mayor Robinson went through the bookings for the upcoming year.

A motion was made by Trustee Bright to approve and authorize the Treasurer to purchase a stage from SICO America, Inc., in an amount not to exceed $16,000, seconded by Trustee Trusner.   A roll call vote was taken:  Bright-yea, Derby-yea, Fritzsche-yea, Otta-yea, Trusner-yea, and Scales-yea.  Motion carried 6-yea, 0-nay, 0-absent.

 

Public Forum:  Ten (10) people were present.  Elsie Farnham, Roberts Drive, stated that she was happy to find out the Village is taking action to clean up her neighborhood, and is hopeful for results.  Asked that a 2007 car that is situated at a residence on State Highway 121 is looked into as she feels the auto is unlicensed.

Tina McElroy, 1434 Rich Lane, stated she had recently received a letter regarding an illegal fence in her front yard; she has since made the fence legal, and requested that her neighbor be made to do the same.  Discussed past property damage and an unlicensed vehicle parked in her neighbor’s driveway.

Rick and Cindy Beck, South Drive, recently discovered they had a water line break at their residence resulting in a large water and sewer bill.  Requested financial relief from the Board on paying this bill.  Clerk Mense was instructed to contact the City of Decatur and the Sanitary District to see if the Village could receive any relief from the gallons of water this break caused. 

 

Administrator & Staff Items:  Chief Dunn updated the board on the bullet proof vests the Department had received via a grant.

Treasurer Miller asked for consensus to hire a part-time employee for opening and closing of Village facilities during events.  Reported she had recently been contacted by the Insurance Broker that the insurance rates for the Village resulted in a 5.5% reduction.  Happily, announced that she is now cancer free. 

Clerk Mense advised that a change to the Open Meetings Act requires public officials and appointed Staff to complete FOIA/OMA training and receive a certificate by December 31, 2012. 

 

Mayor & Trustee Items:  Trustee Fritzsche reported that he has been approached about the need for additional trash receptacles on the bike trail.

Trustee Derby asked if the Nuisance Ordinance needed to be updated.

Trustee Bright asked that a case research be done by the Attorney regarding inoperable/unlicensed vehicles.

Trustee Otta inquired about the state wide bid for squad cars.

 

Adjournment:  A motion was made by Trustee Bright to adjourn the November 7, 2011, Village Board meeting, seconded by Trustee Trusner.  A voice vote was unanimous; motion carried.  The meeting was adjourned at 6:11 p.m.
